Executive Regulation of Article (135) of the Industrial Property Protection Act

Subject: Support for, and the Removal of Obstacles to, the Commercialization of Registered Inventions

At its meeting of 26 July 2026 (4 Mordad 1405), upon the proposal of the Ministry of Industry, Mine and Trade No. 554966 dated 1 July 2025 (10 Tir 1404), and pursuant to Article 138 of the Constitution and Article (135) of the Industrial Property Protection Act (enacted 2024 / 1403), the Council of Ministers approved the Executive Regulation of the aforesaid Article as follows:

Article1

For the purposes of this Regulation, the following terms shall have the meanings assigned to them below:

  • Working Group:The Working Group for Supporting and Removing Obstacles to the Commercialization of Inventions, as referred to in Article (135) of the Industrial Property Protection Act (enacted 2024 / 1403).
  • Registered Invention:An invention in respect of which the registration process has been completed and a patent certificate has been issued by the Registration Authority, irrespective of whether the applicant for registration is Iranian or foreign, and including utility models.
  • Commercialization:The exploitation, in the relevant industry or market, of any economic right arising from the registration of an invention.
Article2

The Working Group shall be composed of the following members:

  • 1.The Minister of Industry, Mine and Trade (Chair of the Working Group);
  • 2.The Minister of Health and Medical Education, or the relevant Deputy Minister;
  • 3.The Minister of Information and Communications Technology, or the relevant Deputy Minister;
  • 4.The Minister of Agriculture Jihad, or the relevant Deputy Minister;
  • 5.The Minister of Justice, or the relevant Deputy Minister;
  • 6.The Minister of Defense and Armed Forces Logistics, or the relevant Deputy Minister;
  • 7.The Minister of Petroleum, or the relevant Deputy Minister;
  • 8.The Minister of Energy, or the relevant Deputy Minister;
  • 9.The Minister of Foreign Affairs, or the relevant Deputy Minister;
  • 10.The Minister of Science, Research and Technology, or the relevant Deputy Minister;
  • 11.The Vice President for Science, Technology and Knowledge-Based Economy;
  • 12.The Prosecutor General;
  • 13.The Head of the Department of Environment;
  • 14.The Head of Islamic Republic of Iran Broadcasting;
  • 15.The President of the Iran Chamber of Commerce, Industries, Mines and Agriculture;
  • 16.The President of the Iran Chamber of Cooperatives;
  • 17.The President of the Iran Chamber of Guilds; and
  • 18.The Head of the State Organization for Registration of Deeds and Properties.

Note 1 — Meetings of the Working Group shall have a quorum when an absolute majority of its members are present, and its decisions shall be adopted by a majority vote of the members present. At its first meeting, the Working Group shall adopt its rules of procedure by a two-thirds majority vote.

Note 2 — The Secretariat of the Working Group shall be established within the Ministry of Industry, Mine and Trade, utilizing the Ministry’s available resources. The Secretariat’s duties shall include conducting supporting studies; preparing draft resolutions; following up on the implementation of resolutions; assessing impacts; preparing periodic reports based on monitoring the implementation of this Regulation; and providing the software and hardware facilities required for the performance of the duties prescribed herein. These duties may be performed by utilizing the resources of the members of the Working Group.

Note 3 — The Working Group may establish specialized working groups (committees) to perform the duties prescribed in this Regulation, including committees organized by reference to different classes of registered inventions or economic ecosystems.

Article3

For the purpose of identifying inventions eligible for commercialization, the State Organization for Registration of Deeds and Properties shall make a list of registered inventions available to the Working Group on a monthly basis, in the format to be specified by the Working Group. To expedite the identification of inventions eligible for commercialization, following the issuance of a patent certificate, the said Organization shall inform the applicant for registration that, if the applicant so wishes, the applicant may also submit a commercialization plan for the invention for referral to the Working Group. Inventions accompanied by a commercialization plan shall be accorded priority by the Working Group. The information template (form) for commercialization plans shall be approved by the Working Group.

Article4

The Working Group shall identify inventions with commercialization potential by applying a market-oriented screening method. Within six months from the date of notification of this Regulation, the Ministry of Industry, Mine and Trade, with the participation of the Iran Chamber of Commerce, Industries, Mines and Agriculture, the Iran Chamber of Guilds, and the Iran Chamber of Cooperatives (the private sector), shall prepare the guidelines for market-oriented screening and submit them to the Working Group for approval.

Article5

On the basis of national or sectoral requirements notified by executive agencies, the Working Group shall determine which registered inventions are to be accorded priority for commercialization. The manner in which national and sectoral requirements are identified shall be determined by the Working Group.

Article6

The Working Group shall refer the lists of registered inventions received, classified by subject matter, to the heads of the relevant agencies. Each such agency shall, as applicable, provide its opinion within no more than one month regarding the feasibility of exploiting or supporting those inventions within the agency, or regarding the manner and extent of support for their commercialization.

Article7

Having regard to the requirements notified by executive agencies and the private sector, the Working Group shall identify registered inventions eligible for the grant of a compulsory license and shall direct the country’s technological capabilities toward their commercialization.

Article8

For the purpose of identifying and commercializing dormant inventions, the Working Group shall adopt the necessary programs at the national or sectoral level, with the participation of the stakeholders in each program.

Article9

The commercialization of defense-related inventions shall be undertaken in compliance with the Executive Regulation of Note 1 to Article (134) of the Industrial Property Protection Act, as set forth in Resolution No. 149993/T64228H dated 30 November 2025 (9 Azar 1404), and subject to the opinion of the Defense Inventions Working Group.

Article10

To enable communication and interaction between the Working Group, inventors, and applicants seeking the commercialization of inventions, the Working Group shall establish a national contact point by utilizing existing resources, particularly smart communications technologies, and shall solicit and receive applications for commercialization through extensive public notification.

Article11

To facilitate and encourage the exploitation of inventions and remove existing obstacles, including financial, legal, and technical obstacles, the Working Group shall undertake the following measures:

  • 1.Facilitate reliable access to professional invention-valuation services, in cooperation with the relevant agencies;
  • 2.Design and facilitate access to innovative financing instruments and methods for the commercialization of inventions, in cooperation with the relevant agencies;
  • 3.Facilitate and expedite the issuance of all types of licenses and permits relating to the commercialization of inventions, and remove obstacles thereto;
  • 4.Assess the need to establish or enhance proof-of-concept and technology-maturation mechanisms at universities, educational and research centers, and other eligible executive agencies, and approve the relevant terms and criteria;
  • 5.Encourage and facilitate the establishment of technology alliances and mechanisms for the joint exploitation of inventions, and approve the relevant terms and criteria;
  • 6.Prepare and make available draft forms of agreements for cooperation, partnership, and investment in the invention-commercialization process, including agreements for pooling and sharing the benefits arising from the commercialization of inventions, and encourage their use;
  • 7.Enable inventors or patent owners to access reference laboratories or other laboratories, prototype-development and pilot-production workshops, and other facilities and resources available within executive agencies or the private sector, in order to support engineering design, prototype production, and other preliminary measures required to prepare inventions for commercialization;
  • 8.Encourage and facilitate the use of testing environments suited to the subject matter of inventions, or establish new testing environments in accordance with the terms and criteria approved by the Working Group; and
  • 9.Provide professional advisory services to inventors, patent owners, or industrial sectors requiring specialized assistance and advice for the commercialization of inventions, subject to the approval of the relevant terms and criteria.
Article12

The Working Group shall adopt the programs necessary to encourage inventors and patent owners to commercialize inventions and to provide training in the requisite skills and processes. By offering various training courses, including at universities, institutions of higher education, and schools, it shall promote a culture of wealth creation through the commercialization of inventions.

Article13

The Plan and Budget Organization of the Country shall, in cooperation with the Ministry of Industry, Mine and Trade and the Vice Presidency for Science, Technology and Knowledge-Based Economy, allocate — pursuant to the annual budget laws — a portion of the resources available under employment-related financial facilities to support the establishment and development of the infrastructure referred to in this Regulation and to fund the relevant equipment and hard and soft technologies, in accordance with the resolutions of the Working Group.
