Stay for an ownership dispute
Where the accused, before the criminal authorities referred to in this Act, raises a claim that the complainant's registration certificate is invalid, then — where acceptable indications and presumptions exist — a stay order (qarar-e enateh) shall be issued in accordance with Article 21 of the Code of Criminal Procedure. In such cases, where there is a risk that the damage caused to the complainant will not be secured, the court may take appropriate security from the accused.
Note — As regards this Article, where it is established that the perpetrator, by raising a baseless claim, intends to protract the proceedings or cause further damage to the complainant, then, upon conviction before the criminal authority, their punishment shall be aggravated by one degree.
