What is not infringement

The following do not constitute infringement of trade secrets:

  1. 1.Where a person, without infringing others' trade secrets, independently and as a result of their own activities, acquires the information;
  2. 2.Where the information was obtained as a result of reverse engineering.

Note — A person who obtains the information by one of the said methods may, if they meet the conditions of Article 122 of this Act, enjoy the legal protection relating to trade secrets in respect of the information obtained.
