Chapter 5 · Trade Secrets

Article 127

The competent authorities are obliged to protect trade secrets that they receive from persons or institutions for the performance of matters such as testing or the grant of authorization; otherwise, those authorities and the agent of disclosure are obliged, in accordance with the rules of civil liability, to compensate the damage, as the case may be. This rule does not prevent the punishment of the agent of disclosure.

Note — In cases where the subject of the court's proceedings is a trade secret, or one of the parties is compelled to present trade secrets in order to defend or prove his claim, the court shall sit in camera.
