Article 108

The owner of a registered mark, or his representative, may bring an action before the competent judicial authority against any person who, without his permission, uses that mark, or commits an act that ordinarily leads to infringement of the rights arising from registration of the mark, or uses a mark that is similar to the registered mark and misleads the public or damages the owner's interests.
