Article 113

Where a license to exploit the mark is granted to another, the owner of the mark is liable toward consumers and third parties for the acts of the licensee in the course of exploiting the mark, as regards quality supervision (control), unless he proves that he effectively and adequately supervised the quality of the licensee's goods or services.
