Article 95

  1. 1.Trademark: any visible sign that distinguishes the goods or services of persons from one another.
  2. 2.Collective mark: any visible sign that is used to distinguish the products or services of a group of persons from the products and services of other persons and is used by the members under the supervision of the owner of the registered collective mark. The owner of a collective mark may be a trade guild, cooperative, union, or the like.
  3. 3.Certification mark: any sign that is used to certify the quality or characteristics of products or services, or the method of production of goods or performance of services; any person who obtains the approval of the holder of the mark or his representative may use that mark for his goods or services.
  4. 4.Trade name: any name or title that identifies and distinguishes the natural or legal person supplying goods or services.

Note — All provisions of this Act relating to trademarks also apply to collective marks and certification marks, except where the Act has specified otherwise.
