Article 98
The applicant for registration must, in addition to paying the statutory fees, annex the following to the application:
- 1.Proof of identity of the applicant or applicants
- 2.A document evidencing the applicant's undertaking to use the mark, or his undertaking to provide evidence of activity in the field of production, distribution, or services in accordance with the executive regulations of this Act
- 3.Proof of the priority right, which must be filed simultaneously with the application or at most within one month from that date (where priority is claimed).
Note — Where the applicant does not use the mark within one year from the date of registration of the mark, or does not provide evidence of his activity, the certificate of registration of the mark shall be deemed annulled as from the date of filing of the application.
