Chapter 4 · Trademarks, Collective & Certification Marks, and Trade Names

Article 97

The application for registration of a trademark must be completed in the Persian language on a special form prepared in accordance with the executive regulations of this Act and must include the following:

  1. 1.A specimen of the mark
  2. 2.A complete description of the mark
  3. 3.The list of goods or services for which registration of the mark is requested, in accordance with the applicable classification or the international classification.

Note 1 — Where registration of a collective or certification mark is requested, inclusion of the designation "collective mark" or "certification mark," as the case may be, in the application is obligatory, and a copy of the rules and conditions of use of the collective or certification mark, with the latest amendments, must be provided. In addition, in the case of a certification mark, a certificate from the competent authority attesting to the competence to register the certification mark must be annexed to the application.

Note 2 — The rules and conditions of use of the collective or certification mark must specify the common characteristics or quality of the goods and services produced in a specified geographical region or certified — as the case may be, for collective or certification marks — under which persons may use the said mark, as well as the sanctions for non-compliance with the said conditions and rules. Any change in the rules and conditions governing use of the collective or certification mark must be declared in writing by the owner of that mark to the Registration Authority. Such changes have no effect before registration, and a summary of the said changes must be published by the Registration Authority.
