Definitions
- 1.Trademark: any visible sign that distinguishes the goods or services of persons from one another;
- 2.Collective mark: any visible sign used to distinguish the products or services of a group of persons from the products and services of other persons, used by members under the supervision of the owner of the registered collective mark. The owner of a collective mark may be a guild, cooperative, union, or the like;
- 3.Certification mark: any sign used to certify the quality or characteristics of products or services, or the manner of producing goods or rendering services, which any person who obtains the certification of the mark holder or their representative may use for their goods or services;
- 4.Trade name: any name or designation that introduces and identifies the natural or legal person supplying a good or service.
Note — All the provisions concerning trademarks set out in this Act apply to collective marks and certification marks as well, except where the law specifies otherwise.
