Article 143
Examination of disputes and actions arising from implementation of this Act and its executive regulations falls, as the case may be, within the jurisdiction of the branches of the Special Intellectual Property Judicial Complex located in Tehran, which shall be established by the Head of the Judiciary within six months from the date this Act enters into force. The prosecutor's office examining the offenses referred to in this Act shall likewise be attached to the criminal courts of Tehran and shall be created by the Head of the Judiciary at most six months after the date this Act enters into force.
Note 1 — Disputes arising from this Act may be referred to arbitration, unless their subject matter is a dispute over the fundamental validity of the rights.
Note 2 — The judges of the Special Intellectual Property Complex must possess legal knowledge relevant to intellectual property.
Note 3 — The specialized nature of the prosecutor's office and courts referred to in this Article does not prevent the referral of other cases to those authorities.
Note 4 — Until the establishment of the Special Intellectual Property Judicial Complex in Tehran, Article 59 of the Law on Registration of Patents, Industrial Designs and Trademarks, adopted 1386/8/7 [29 October 2007], shall apply.
