Prior foreign applications
Where the applicant, before filing the application with the Registration Authority, has filed a patent application abroad that is identical to, or substantively related to, the same invention filed in the application submitted to the Registration Authority, the applicant must — in addition to the number and date of that application — submit the following documents as annexes to the said authority:
- 1.A copy of any decision, letter, or notice that the applicant has received concerning the results of the examinations carried out on the applications filed abroad;
- 2.A copy of the patent registered on the basis of the applications filed abroad (if any);
- 3.A copy of any final decision rejecting the application or refusing the patent claimed in the applications filed abroad;
- 4.A copy of any final decision invalidating the patent issued on the basis of the applications filed abroad.
Note — The said applicant may register the invention in Iran only where no more than twelve months have elapsed since the filing of their first application abroad.
