Article 54

The moral aspects of the rights arising from the invention include the following:

  1. 1.Mention of the name of the creator of the invention as the inventor: the inventor or inventors have the right to have their names mentioned as inventor in the patent certificate, even if the economic rights arising from registration of the invention belong to another. Nevertheless, the inventor may request the Registration Authority in writing that his name not be mentioned as inventor, in which case his name shall not appear in the patent certificate.
  2. 2.Enjoyment of recognition and awards: recognition, rewards, monetary prizes, and privileges that in any manner attach to the invention as a scientific achievement belong to the inventor, even if the economic rights arising from registration of the invention belong to another.

What are the moral rights of an inventor in Iran?

The inventor has the right to be named as inventor in the patent — or to ask not to be named — and to keep any recognition, awards or prizes given to the invention, even where another person owns the economic rights. Moral rights are perpetual and cannot be transferred.
