Process inventions: scope

Where the invention takes the form of a process, the economic rights arising from the patent are:

  1. 1.Use of the process;
  2. 2.The acts set out in Article 36 of this Act in respect of products obtained directly through the process, except for plant or animal varieties.

Note — As regards biological processes covered by the patent that bring about the multiplication of the claimed genetically modified microorganism, products obtained directly from the multiplied genetically modified microorganism are also subject to this Article.
