Patent infringement defined

The performance of any act that prejudices the exclusive rights of the patent holder or their successor constitutes patent infringement, provided that such acts take place after the date of registration of the invention.

Note — The performance of any of the acts set out in Article 38 of this Act does not constitute patent infringement.
