Exploitation requires consent

Exploitation of an invention registered in Iran by persons other than the owner of the invention is conditional upon the consent of the owner or their representative or successor. The owner of a registered invention, or their representative or successor, may — subject to Articles 38 and 58 of this Act — bring a civil action or criminal complaint, as the case may be, before the competent judicial authority against any person who, without the permission of the owner or their representative or successor, performs one of the acts set out in Articles 36 and 37 of this Act and thereby infringes their rights.
