Article 64

The owner of the invention may, by filing a notice of abandonment with the Registration Authority, abandon his rights in respect of the registered invention. Abandonment may be total or partial, and may relate to the entire patent certificate or to one or more claims. The effect of abandonment runs from the time of filing of the request for abandonment with the Registration Authority.

Note 1 — Abandonment by the owner of the invention of his rights in respect of the registered invention is conditional upon the said rights not having been attached by the judicial authorities and not being the object of a right of another.

Note 2 — In the case referred to in Clause 4 of Article (39) of this Act, the holder of the compulsory exploitation license for the later invention may not abandon the patent right without the permission of the holder of the certificate of the earlier invention. In that case, the abandonment must be declared to the Registration Authority in writing, accompanied by the consent of the interested party.

Note 3 — The Registration Authority shall declare the said request to the interested parties of the patent registration and, after receiving the relevant fee, shall publish it.

Note 4 — Abandonment by the owner of the invention of his rights in respect of the registered invention shall not prevent the filing or continuation of proceedings in an action for invalidation of the patent certificate.
