Transfer of a compulsory licence

The right arising from a compulsory license for an invention under paragraphs 1, 2, and 3 of Article 39 of this Act is not independently assignable and must be transferred together with the enterprise or business of the compulsory licensee granted by the board referred to in Article 40 of this Act, or together with the part of the enterprise or business in which the invention is exploited.
