National-emergency licences
Where, as determined by the board referred to in Article 40 of this Act, the urgency of national interest and public benefit so requires, compliance with the conditions set out in paragraph 2 of Article 41, Articles 42 and 43, and the final part of Article 44 (payment of the exploitation remuneration) of this Act, as well as observance of the relevant time limits, is not required. The board's decision in this case shall take effect immediately, and the secretariat shall notify the owner of the invention of it within twenty days.
Note — Where this Article is applied, the exploitation remuneration referred to in Article 44 of this Act shall be paid to the patent holder within two months at most of the issuance of the compulsory license.
