Article 45
Where, as determined by the board referred to in Article (40) of this Act, the urgency of national interest and public benefit so requires, compliance with the conditions prescribed in Clause 2 of Article (41), Articles (42) and (43), and the final part of Article (44) (payment of the exploitation consideration) of this Act, as well as observance of the relevant time limits, is not necessary. The board's decision in such a case shall be implemented immediately, and the secretariat shall notify it to the owner of the invention within twenty days.
Note — Where this Article is applied, the exploitation consideration referred to in Article (44) of this Act shall be paid to the holder of the patent certificate within at most two months after issuance of the compulsory exploitation license.
