Withdrawal of the application
The patent applicant may withdraw their application before the issuance of the patent. Where there are several applicants, the request for withdrawal must be made with the consent of all of them. Where the rights in the application have been assigned to a third party, withdrawal of the application is not possible. An interested party may raise their objection to the withdrawal before the Board referred to in Article 23 of this Act.
Note 1 — In the event of withdrawal, rejection, or abandonment of the application, the fees paid are non-refundable.
Note 2 — Where the withdrawn application has served as the basis for other divisional applications, the withdrawal shall have no effect on the subsequent applications, provided that the divisional applications were submitted to the Registration Authority before the date of withdrawal.
